开标及评标：
Bid opening and evaluation:
（1）开标；
(1) Bid opening:
a、招标方按照招标文件规定的时间、地点主持公开开标，有评标委员会代表、委托方代表及有关工作人员和投标方代表参加。
a. The tenderee shall publicly open the bids at the time and in the
place as stipulated in the tender document, and the representative of
the bid evaluation committee, the representative and relevant workers of
the authorized party, and the bidders' representatives shall attend the
bid opening.
b、开标时查验投标文件密封情况，确认无误后拆封唱标，招标方作唱标记录。
b. All bids shall be checked for their sealing, and then unsealed and
announced if correct, and the tenderee shall record the bid
announcement.
（2）投标文件的澄清：
(2) Clarification of tender document:
a、招标方有权就投标文件中含混之处向投标方提出询问或澄清要求。投标方必须按招标方通知的时间、地点与技术和商务人员进行答疑和澄清。
a. The tenderee shall be entitled to raise inquiry or clarification
requirements to the bidders for any ambiguity in their bidding
documents, and the bidders must answer and clarify such ambiguities to
technical and commercial personnel at the time and in the place as
notified by the tenderee.
b、必要时招标方可要求投标方对澄清的问题做出书面回答，由投标方全权代表盖章、签字后交招标方作为投标内容的一部分。
b. If necessary, the tenderee can ask the bidders to answer the
questions to be clarified in writing, and such answer shall be part of
the bid as soon as it is sealed, signed, and submitted to the tenderee
by the relevant bidder’s authorized representative.
c、招标、投标文件与技术文件不一致时，以技术文件为准；招标、投标文件与澄清内容不一致时，以澄清文件为准。
c. In case of any discrepancy among the tender document, the bidding
documents and the technical documents, the technical documents shall
prevail; and in case of any discrepancy among the tender document, the
bidding documents, and the clarification documents, the clarification
documents shall prevail.
（3）评标：
(3) Bid evaluation:
a、招标方根据招标产品的特点组建评委会，对具备实质性相应的投标文件进行评估和比较。评委会由招标方、有关专家组成。
a. The tenderee shall set up a bid evaluation committee according to the
characteristics of the tendered products to evaluate and compare
substantially corresponsive bidding documents. The bid evaluation
committee shall comprise the tenderee and relevant experts.
b、评标的原则：
b. Principles of bid evaluation:
评标严格按招标文件的要求和条件进行评标，同时考虑以下因素：
All bids shall be evaluated strictly according to the requirements and
conditions of the tender document, taking into account the following
factors:
①产品的性能、质量；②产品的寿命；③售后服务、备件供应；④经营业绩、信誉以及用户评价。
① Product performance and quality; ② Product life; ③ After-sales service
and supply of spare parts; ④ Operating performance, reputation and
users’ evaluation.
c、中标条件：
c. Conditions for awarding the contract:
①投标文件符合招标要求；②综合指标最优；③有履行合同的能力。
① The bidding documents comply with the tender requirements; ② The
composite indicator is optimal; ③ the bidder is capable of performing
the contract.
d、在评标期内，投标方企图干扰招标方的任何行为，将导致投标被拒绝，并承担相应法律责任。
d. During the period of bid evaluation, any act conducted by the bidder
attempting to interfere with the tenderee will result in the bid being
rejected, and the bidder shall bear the corresponding legal
responsibility.
13、签定合同：
13. Execution of contract:
（1）中标方应按中标通知规定的时间、地点与买方签定中标经济合同，否则按开标后撤回投标处理。
(1) The winning bidder shall sign an economic contract with the buyer at
the time and in the place as notified by the letter of acceptance;
otherwise, the bid will be deemed as withdrawn after bid opening.
（2）签定合同后卖方根据买方的要求和供货计划按期供货并保证质量，若出现质量问题，供方承担一切损失；未经买方允许延期交货的，每迟一天按迟交货款2%从货款中计扣违约赔偿费；如因延期交货给生产造成严重损失的，可终止合同并按损失价值另行索赔。
(2) After signing the contract, the seller shall supply goods on time
according to the buyer’s requirements and delivery plan and guarantee
quality; in case of any quality problem, the seller shall bear all the
losses; in case the delivery of goods is delayed without the buyer’s
permission, liquidated damages equivalent to 2% of the payment of goods
shall be paid for each day delayed; in case of serious damage caused as
a result of the delayed delivery, the contract can be terminated, and
the buyer can further claim against compensation according to the value
of the losses.
