第二部分  额外费用责任

Part II Responsibilities for Extra Expenses

保险责任

Insurance Cover

第九条  在保险期间内，保险人负责赔偿被保险人及其雇员、代理人、其他独立经营人经营物流业务过程中，因疏忽和过失造成被保险人应承担的额外费用损失，但仅限于被保险人及其雇员、代理人、其他独立经营人：

Clause 9 The loss of additional costs to be borne by the Insurant due to his negligence and fault when the Insurant and his employee, agent or other independent operator undertakes logistics business within the period of insurance, but only limited to the Insurant and his employee, agent or other independent operator: 

1、非故意地延迟履行合同义务；

    Unintentional delay in performing contractual obligations;

2、提单、运单或其他相关单证或操作文件的不正确声明或遗漏；

   Incorrect declaration or omission of bill of lading, waybill or other related vouchers or operating documents;

3、在海关监管仓库监卸、监装和储存保管不当；

   Improper supervision of unloading, improper supervision of loading and improper storage in the warehouse under the supervision and control of customs;

4、由于报关、报检、报验疏忽或违反有关部门的规章制度，而被征收的罚金、罚款、额外税费或类似费用；

   Fine, penalty, additional taxes or similar fees that are collected due to negligence in customs declaration, application for quarantine inspection and application for examination or breach of rules and regulations of related departments;

5、货物未发、错发、迟发、错运、错交、迟交、未及时通知收货人、无人提货或提货不及时；

   Non delivery, wrong delivery, late delivery, wrong transportation, wrong handover, late handover, untimely notification to the consignee, unclaimed cargo or untimely claim of cargo;

6、发生第五条列明的保险事故后，产生的检疫和消毒等额外行为。

   Additional actions such as quarantine inspection and disinfection that are taken after any insurance accidents listed in Item 5 above happen.  

第十条　被保险人因本部分保险事故而发生的法律费用，保险人负责赔偿。

Clause 10 The Insurer shall be responsible to compensate for the legal fees arisen from any insurance accident that is included in this part in case it happens to the Insurant.

责任免除

Liability Exemption

第十一条  对下列损失、费用和相关责任，保险人不负赔偿责任：

Clause 11 The Insurer shall not be responsible to compensate for the following losses, expenses and related responsibilities:

1、被保险人在正常的业务操作过程中向有关部门交纳的必要的合理的费用；

   The necessary and reasonable expenses to be paid by the Insurant to related departments in normal operating process of business;

2、运输工具发生意外事故后，为修复运输工具而支付的修理费、清理运输工具残骸的费用；

      The expenses paid for repair of transportation facility and for clearing up of remains of the transportation facility after it has an unexpected accident.

3、因货物的散落或运输工具燃料的泄漏而发生的清污费。

   The clean-up expenses arisen from scattering of goods or fuel leakage from the transportation facility.

 

第十二条  被保险人把未发、错发、迟发、错运、错交的货物通过空运运往正确目的地产生的损失、费用和责任，保险人不负责赔偿。除非：

Clause 12 The Insurer shall not be responsible to make compensation for the losses, expenses and responsibilities when the Insurant transports the goods involved in non delivery, wrong delivery, late delivery, wrong transportation or wrong handover to the correct destination by air transport unless:

1、对该批货物最初的运输合同就已经要求空运； 或

   Air transportation is required for the same batch of goods in the initial transportation contract; or

2、经保险人事先书面同意。

  Air transportation has been agreed upon by the Insurer with prior written consent.
