Part III Responsibilities of the Third Party

保险责任

Insurance Cover

第十三条  在保险期间内，被保险人及其雇员在从事物流经营活动中由于疏忽、过失或发生意外事故造成下列损失或费用，依法应由被保险人承担的经济赔偿责任，保险人负责赔偿：

Clause 13 The Insurer shall be responsible to compensate for the economic losses or expenses which, in accordance with the Law, must be borne by the Insurant when the Insurant and his employee have any unexpected accident due to negligence or fault when they undertake logistics business within the period of insurance:

1、第三者的财产损失、人身伤亡及由此产生的相关费用等非合同赔偿责任；

   Non-contractual liabilities such as property losses and human injury or death of the third party and the related expenses;

2、对于物流服务中签订的设备出租/转让合同、分包合同、联合服务合同等，由合同的另一方（非被保险人）所引发的第三者的人身伤亡和/或财产损失，依法应由被保险人承担的经济赔偿责任；

   The economic compensation liabilities which must be borne by the Insurant in accordance with the Law for any human injury or death/property losses of the third party initiated by another party of the Contract ( non-Insurant) with regard to equipment lease/assignment contract, subcontract, joint service contract, etc. that have been awarded in the logistics service; 

3、发生本部分保险事故时，被保险人为减少对第三者人身伤亡或财产损失的赔偿责任所支付必要的、合理的施救费用。

   Necessary and reasonable sue and labor charges that are paid by the Insurant in order to reduce his liability to damages for the human injury/death or property losses of the third party when any insurance accident included in this part happens. 

第十四条  被保险人因本部分保险事故而发生的法律费用，保险人负责赔偿。

Clause 14 The Insurer shall be responsible to make compensation for the legal fees in case the Insurant has any insurance accident included in this part.

责任免除

Liability Exemption   

第十五条  下列损失、费用和相关责任，保险人不负赔偿责任：

Clause 15 The Insurer shall not be responsible to compensate for the following losses, expenses and related liabilities:

1、被保险人或其代表、雇员人身伤亡和财产损失；

   Human injury or death and property losses of the Insurant or his representative or employee;

2、拥有公共牌照的运输工具发生意外事故造成第三者的人身伤亡和财产损失。
