Agreement on Fractional Payment of Electric Charge of High Voltage Users

    为维护正常供用电秩序，保护合法用电客户的利益，保证电费回收，根据《中华人民共和国电力法》、《电力供应与使用条例》、《供电营业规则》，约束供电企业(以下简称供电方)和用电单位(以下简称用电方)共同信守、严格履行双方责任，签订以下双方共同遵守执行的电费结算条款：

To maintain normal power supply and use, protect the interests of legal users and recover electric charge, these terms and conditions on the settlement of electric charge are hereby made and entered into by and between the power supply enterprise (hereinafter referred to as the “Supplier”) and the power user (hereinafter referred to as the “User") in accordance with the Electric Power Law of the People’s Republic of China, Regulation on the Supply and Utilization of Electricity, and Regulation on Power Supply and Marketing as follows:

    一、计价依据及方式

I. Pricing Basis and Mode

    供电方按照有管理权的物价行政主管部门批准的电价和用电计量装置的记录，向用电方定期结算电费及随电量征收的有关费用，在协议书有效期内，发生电价和其它收费项目费率调整时，按调价文件规定执行。

The Supplier shall periodically collect electric charge and the related charges from the User based on the price specified by the competent administrative department and the record shown in the electricity meter. If there is any change to the electricity price and / or other related charges during the effective period of this Agreement, the provisions of the relevant price adjustment document shall apply.

    二、电费(含分次结算)结算方式

II. Settlement Mode of Electric Charge (incl. fractional payment)

    l、供电方应按规定日期抄表，按期向用电方收取电费(含分次结算)。

1. The Supplier shall read the meter on schedule and collect electric charge (incl. fractional payment) from the User periodically.

    2、用电方应在供电方规定期限内全额交清电费(含分次结算)。

2. The User shall pay up the electric charge (incl. fractional payment) within the time specified by the Supplier.

    三、交付电费方式(含分次结算)

III. Payment Mode of Electric Charge (incl. fractional payment)

    用电方每月一次向供电方交付电费(含分次结算)。

The User shall pay the electric charge (incl. fractional payment) once per month.

    1、每月的15-17日结清当月全部电费并交付下月分次结算电费(本月电费的95％)，2月份结合春节日期临时通知结清当月全部电费并交付下月分次结算电费(本月电费的95％)。

1. The 15^th to 17^th date of a month: the electric charge of that month shall be paid up and the fractional payment of the next month (i.e. 95% of that of current month) shall be paid. However, in February: the electric charge of that month shall be paid up taken into account the Spring Festival and the fractional payment of the next month (i.e. 95% of that of February) shall be paid.

    2、分次结算电费多退少补。

2. Regarding the fractional payment, any payment in excess shall be refunded and any deficiency shall be made up.

    3、交费时间为周一至周五早8：30-下午4：00，周六、周日、节假日顺延。

3. The User shall pay the electric charge from 8:30 to 16:00 Monday through Friday. In case of a Saturday, Sunday, legal festival or holiday, the payment time shall be extended accordingly.

    四、用电方不得以任何方式、任何理由拒付电费(含分次结算)。

IV. The User shall not decline to pay the electric charge (incl. fractional payment) by any mode or for any reason.

    用电方对用电计量、电费有异议时，应先交清电费(含分次结算)，然后双方协商解决。

If the User has any objection against the metering and / or electric charge, the User shall pay up the electric charge (incl. fractional payment) and then settle the dispute through consultations with the Supplier.

    五、用电方未按协议约定的期限结清电费(含分次结算)的，按规定计收电费违约金(含分次结算)。

V. If the User fails to settle the electric charge (incl. fractional payment) within the time specified herein, late fee shall be charged in accordance with the relevant stipulations (incl. fractional payment).

    电费违约金从逾期之日起计算至交纳日止，每日电费违约金按下列规定计算：当年欠费部分，每曰按欠费总额的千分之二计算，跨年度欠费部分，每日按欠费总额的千分之三计算。同时按照规定依法停电，因停电造成的损失全部由用电方自己承担。用电方未按规定期限结清分次结算电费的，按欠电费户处理。

The late fee shall accrue from the date on which the payment becomes overdue until the payment is paid up. Calculation of daily late fee: for the payment in arrears of a year, the late fee shall be 2‰ of the payment in arrears; for the payment in arrears of the previous year, the late fee shall be 3‰ of the payment in arrears. In addition, the Supplier may cease power supply in accordance with the relevant stipulations and any and all losses caused thereby shall be assumed by the User. Any User fails to settle the fractional payment within the specified time shall be regarded as a user in default.
